1. Use of the Site
(a) You may access www.muesliandco.co.nz solely for your own personal use. You must not use any content of the website for any commercial or illegal purpose.
(b) You will indemnify us if any third party takes action against us in relation to the material used in this website. You fully agree to indemnify, defend and hold us (Muesli and Co Ltd) from and against all claims, liability, damages, losses, costs and expenses which includes all reasonable legal fees, arising out of any breach of the conditions by you or other liabilities arising out of your use of this website, or by the use of any other person accessing the site and gaining your personal information.
(c) You must not cause any nuisance, annoyance or inconvenience to us, our customers or our users of the website.
(d) You must not submit any offensive, menacing or obscene material to the website or information which in our opinion may cause nuisance, annoyance, damage or inconvenience to us or any other person or which is illegal. We may remove such material from the site at any time without notice to, or consent by, you.
(e) We reserve the right to suspend the website at any time for operational, regulatory, legal or other reasons. We may terminate your use of the website with immediate effect if you breach any of the Terms laid out by Muesli and Co Ltd.
(f) Any dealings by you with any third party on or through the website shall be solely between you and that third party and we shall not be responsible for any loss or damage that may arise from any such dealings, nor shall we be deemed to be acting as an agent for you in any such dealings.
(g) Muesli and Co Ltd will not be liable for loss resulting from any action or decision by you in reliance on the information on its website, nor any interruption, delay in operation or transmission, virus, communications failure, Internet access difficulties, or malfunction in equipment or software.

(a) Muesli and Co and other owned names and / or logos contained in this site are trademarks and / or registered to Muesli and Co Ltd owners. Copyright in the design, text, photos and graphics contained in the website is held by Muesli and Co Ltd Muesli and Co reserves its rights in respect of this.
(b) Except as expressly authorised by us or relevant third parties, you agree not to copy, download, adapt, alter, modify, rent, lease, loan, sell, distribute or create derivative works of any content of the Site, in whole or in part.
(a) Your use of the Muesli and Co Ltd website is at your sole risk. The site is provided on an "as is" and "as available" basis and we do not guarantee that the website will be suitable for your purposes or requirements. If your computer does not support relevant technology including encryption, you may not be able to use certain services or access certain information on the website.
(b) All material on this website is provided in good faith, and is derived from sources believed to be accurate and up to date at the date of publication. Muesli and Co Ltd will not take any responsibility arising in any way for errors in, or omissions from information provided on the website.
(c) Our website is accessed via the World Wide Web which is independent of us. Your use of the World Wide Web is solely at your own risk and subject to all applicable national and international laws and regulations. We shall have no responsibility for all information or service obtained by you on the World Wide Web.
(d) The content of the website has been compiled from a variety of sources and is subject to change without notice.
(a) Muesli and Co Ltd operates under the NZ Food Hygiene Regulation with all aspects of food quality and safety from food purchase, storage, transportation, processing and distribution.
(b) Allergies and intolerances: If you have any food allergies or intolerances, it is your responsibility to check all the ingredient components before ordering. Our muesli products are packed in a registered kitchen that handles peanuts, tree nuts, gluten, soy, milk products, sesame seeds and sulphites, so our muesli productss are not suitable for people with severe nut allergies.
The term ‘No gluten-containing ingredients’ may be used on some of our products where gluten has not been intentionally added, but a small amount may be present from contact with other food. The majority of coeliacs will be able to eat these products but should speak to a dietician or healthcare professional to find out whether, or how often, they can eat them.
5. General Information
(a) These Terms constitute the entire agreement between you and Muesli and Co Ltd..
(b) Any failure by us to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision.
(c) These Terms and the relationship between you and us shall be governed by the laws of New Zealand and the New Zealand courts shall have non-exclusive jurisdiction over any dispute.
(d) We reserve the right to vary the Terms from time to time, such variations becoming effective immediately upon posting to our website and by continuing to use it, you will be deemed to accept any such variations.
Terms of Sale
1. Conditions of Sale
In order to create a contract between you and us, please follow the simple on screen instructions taking you through the process of placing an order on the website. To place an order for the products select go to the checkout page, confirm your order details. In doing this you offer to buy the Goods at the prices indicated as well as any applicable delivery charges.
The acceptance of your order and the completion of the contract between you, the purchaser and us, Muesli and Co Ltd, will take place on dispatch of the products unless we have notified you that we have not accepted your order or you have cancelled it. Once we have accepted your order it becomes binding, subject to your rights of cancellation.
Non-acceptance of an order by us will occur in circumstances such as:
- we identify a pricing or product description error;
- the ordered product is out of stock or unavailable;
- or if we are unable to obtain authorisation for your payment.
2. Pricing and Availability
We reserve the right to add or withdraw any products from this website at any time and/or remove or edit any materials or content on this website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this website whether or not that product has been sold; removing or editing any materials or content on the website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
All the prices in our website are in New Zealand dollars (NZD), and GST inclusive. GST is currently charged at 15%. We reserve the right to alter prices should the GST rate change or should our suppliers increase their prices.
(a) In general, shipping within New Zealand takes 3-5 business days and standard New Zealand Post will be used. This is not a guaranteed service, but we make every effort to have your products with you in good time.
(b) It is imperative that during the order process the buyer enters the correct delivery address. If there is any buyer error in the address specified, redelivery to the correct address will incur an additional delivery charge.
(c) Muesli and Co Ltd makes every effort to ensure products are described and photographed clearly, as well as packaged in a manner to ensure they arrive in the best possible condition. It is the buyer’s responsibility to promptly advise Muesli and Co Ltd if an order is not delivered when expected. We will not be held liable for any loss or damage arising from a late or missing delivery. A late delivery does not constitute reasonable means to cancel an order. But as customer’s satisfaction is a priority for us, we will make every effort to mediate a positive resolution to any problems with orders.
(d) If you wish to have your item couriered at additional expense to you, please contact us and we will provide this service.
(e) For international deliveries, please contact us for a freight quotation.
4. Refund policy
Products supplied in accordance with the buyer’s order can only be returned with our expressed approval on the following conditions:
(a) Requests to return products must be submitted within 15 days from the date of shipping and the original invoice number must be quoted;
(b) Where the return of products is accepted for credit or refund, they must be delivered at the buyer’s expense in original condition and packaging to Muesli and Co Ltd
(c) Returned products are the buyer’s responsibility until they reach us;
(d) We shall not be responsible for misdirected shipments or product’s lost or damaged in transit;
(e) Any refunds (at our discretion) will be refunded in the form of the original payment method used by the buyer and at the full purchase price (excluding all delivery charges);
(f) When returning goods it is imperative that buyer repackages goods adequately to prevent damage in transit, retains proof of delivery until we can confirm receipt of the item. We do not accept any responsibility for any returned item that goes missing or is damaged in transit;
(g) We will not refund "specials/sale" items.
6. Gift vouchers
Gift vouchers are valid for a period of 12 months from the date of issue and it is up to you to use the full value before expiry date. Cash or Credit will not be given for any unused balance. If purchase exceeds available voucher balance, you must make up difference with another payment method. Vouchers are not redeemable for cash.
You are liable for all transactions on your voucher except to extent to which there has been fraud or negligence by Muesli and Co Ltd or any of our employees. Additional values cannot be added to an existing voucher however, additional gift vouchers can be purchased on our website.
All deliveries are subject to approval of online payment. Orders for gift vouchers placed on business days between the hours of 9am - 5pm are generally processed immediately. Purchases made outside these hours, on weekends or public holidays may take up to 12 hours to process. Muesli and Co Ltd will not be responsible for late delivery due to internet connection problems or incorrect details or payment information submitted by the purchaser.
Muesli and Co Ltd does not accept any responsibility for lost or stolen vouchers.
When purchasing from our website, we will ask you to input some personal information such as your name, address, email address, telephone number, delivery address, billing address and credit card information. However, we do not require that you give us any information about yourself before you reach the checkout area of our site.
We treat all your personal information as completely confidential. We will only use this information to:
- Process your orders
- To contact you with special offers, competitions or to notify you of new products.
- For statistical information to help us improve our website, services and products we offer to you.
We will not under any circumstance pass your personal information onto any third parties.
If you wish to unsubscribe yourself from our mailing list then please reply to any promotional e-mail with the word UNSUBSCRIBE in the subject line.
We do not have access to your credit card information as this is dealt with by our secure payment option, Paypal. Your credit card information is not stored and after the transaction has been completed, there will be no record of this.
We have taken every reasonable precaution to ensure that the personal information that you provide to us on this website is safe and secure.
